The Court of Appeals has set aside the six-month suspension without
pay dated March 7 of Bacong Mayor Rodolfo Yee by the Visayas Ombudsman
that had been based on a criminal complaint filed by a dismissed
employee.
The appellate court also cleared Yee of the charges of oppression
in terminating the employment of Eve Morados in November 10, 2004.
The decision of the 19th Division of the CA was penned by Associate
Justice Isaias Dicdican and concurred to by Associate Justices Antonio
Villamor and Stephen Cruz.
Provincial legal officer Erwin Vergara said the decision refers
to the case where Yee was able to secure a temporary restraining
order, a day before incumbent Vice Mayor Lenin Alviola took over
as mayor in Bacong.
Alviola's assumption to office is now the subject of another complaint
filed by Yee.*JG
