A resident of Escalante City, Negros Occidental was sentenced to suffer 14 years in prison Wednesday for killing his neighbor about eight years
San Carlos City, Negros Occidental, Regional Trial Court Branch 59 Judge Kathrine Go, found Sunny Dañoso, “alias Daboy,” guilty beyond reasonable doubt of the crime of homicide filed against him.
The judge also ordered him to pay the victim P50,000 as civil indemnity and moral damages to the family of his victim, Rogelio Dolloso.
Information filed by San Carlos City Prosecutor Ranela De la Fuente in court showed that at about 8 p.m. of Sept. 16, 2004, Dañoso was on his way home in Sitio Pinaglapaan with his daughter Mayet and the lone witness Cheryl Francisco when they met Francisco’s mother Shirlita and Dolloso.
Francisco told the court that Dolloso greeted her and Dañoso without provocation took out his bladed weapon and attacked the victim. She also said that Dolloso fought back by shooting Dañoso, who grappled with the victim to wrest the firearm until they both fell to the ground.
Edgar Vaflor, Assistant City Health officer of Escalante, who performed the autopsy on Dolloso, said the victim succumbed to four stab wounds.
Dañoso, meanwhile, told the court that he was walking home with his daughter Mayet and Francisco when they meet Dolloso and greeted him but the victim instead of replying shot him on the shoulder.
Dañoso stressed that what happened was self defense and that he was only forced to pull out his knife and stab Dolloso several times.
In her 3-page decision, Go said that between the version of events presented by the prosecution through Francisco and the accused, the court is inclined to give weight and credence to the testimony of Francisco because her narration was in clear and straightforward manner.*APN
