Labor Regional Director Ponciano Ligutom yesterday reminded employers to observe the proper pay rules for their workers on Monday, Tuesday and August 27, which have been proclaimed holidays.

Employees are urged to report non-compliance by their employers of the holiday pay rule to the Region 6 Department of Labor and Employment hotlines at 09173275919 and 09173276515, he said.

“If employees text their complaints to us we will send an inspection team to their firm and compel their employers to comply,” he said.

Monday, August 20, is a regular holiday in view of the celebration of Eid’l Fitr, or Feast of Ramadan, while Tuesday, August 21, is a special non-working day it being Ninoy Aquino Day.

August 27 is a regular holiday in commemoration of National Heroes Day.

Workers who will be required to report for work during the holidays must receive the correct wages, he said.

A DOLE advisory states that for the regular holidays on August 20 and 27 if an employee did not work during those days, he or she will be entitled to 100 percent of salary for those says.

If the employee reported for work on August 20 or 27 , he or she will be entitled to 200 percent of the regular salary for that day for the first eight hours, and for overtime work an additional 30 percent to the set hourly rate, the advisory said.

On August 21, a Special Non-Working day, the “no work, no pay” principle will apply, unless there is a favorable company policy, practice or collective bargaining agreement (CBA) granting payment, the advisory added.

If worked, the employee will be entitled to an additional 30 percent of his or her daily rate for the first eight hours of work, and an additional 50 percent if August 21 falls on the employees rest day, it said.

In excess of eight hours, the employee will be entitled to an additional 30 percent of his or her hourly rate on such special day, the advisory added.*CPG
