Cops file rape
raps vs. driver

Charges for rape and frustrated homicide will be filed today at the Bacolod City Prosecutor’s Office against a tricycle driver who allegedly raped and attempted to kill a 20-year-old waitress in Brgy. Bata Wednesday.

The charges will be filed against Albert Magbanua, 27, of Purok Bayabasan in Brgy. Bata, City Police Office Director Senior Supt. Ricardo de la Paz said.

Women and Children’s Complaints Desk chief, Insp. Jovy Cabcaban, said that among the evidences they will present are the victim’s affidavit and medical certificate, and the affidavits of the apprehending officers.

De la Paz said that, based on the injuries the victim sustained, Magbanua had intentions to kill her. He said they will be subjected to drug tests because they have received information that Magbanua is also into marijuana use.

Magbanua had bite marks and bruises in his knees when he was arrested, the police said.

De la Paz, Station 3 chief, Senior Insp. Jose Mulleta and Special Operations Group head, Supt. Santiago Rapiz visited the victim Wednesday at the Corazon Locsin Montelibano Memorial Regional Hospital, where she is now confined.

De la Paz said the victim’s family told them that they cannot forgive the suspect and they are determined to put him behind bars so he could no longer victimize other women.

Magbanua denied the accusations, but De la Paz said the victim positively identified him and a sweatshirt with bloodstains and the victim’s fan were recovered from his tricycle.

Police records also show that he had been convicted for rugby use, but he was able to avail of probation

The victim, also of Brgy. Bata, had come from her workplace and rode Magbanua’s tricycle to go home at about 1 a..m. Wednesday.

However, instead of bringing her home, Magbanua allegedly brought her to a sugarcane field, where he raped her and hit her head with a hard object.

The victim pretended to be dead and later went homeafter the suspect was gone to seek help from her family.*APN
