The Deputy Ombudsman for the Visayas has given course to the criminal complaint filed by Councilor Caesar Distrito against Bacolod Sanggunian Secretary Nilo Alejandrino.
Distrito had filed criminal charges against Alejandrino for two counts of threat and violation of Republic Act 9442, or the Magna Carta for Persons with Disabilities.
The case was an offshoot of an incident on October 24, 2011 at the SP Office when Distrito complained that Alejandrino had altered the notices of hearing of the Committee on Laws, which he chaired, by placing the term 'casual employee' in the space provided for the name of City Legal Officer Joselito Bayatan.
Distrito said he and Alejandrino had a verbal confrontation when he asked the SP Secretary not to alter the notices of hearing.
In its letter dated December 16, 2011, the Office of the Deptuy Ombudsman for the Visayas, said it has received the complaint and supporting documents and has docketed it as an Ombudsman case under OMB-V-C-11-0661-L and OMB-V-A-11-0819-L.
It also said that the case had been assigned to an investigation officer that that the respondent has been required to submit his counter-affidavit.
The action taken by the Ombudsman was very timely since the administrative hearing against Alejandrino had also started on Jan. 10, 2012 and was conducted by the Investigation Committee composed of Councilors Dindo Ramos, Homer Bais and Roberto Rojas, Distrito said.
Alejandrino, had earlier denied the claims of Distrito saying that the words he uttered was just rhetoric and not meant to ridicule him. He also said the chair-throwing incident just a figment of Distrito’s imagination, because he just took a chair to sit on but it slipped from his hand.*CGS
