Ombudsman seeks report on
8 cases vs. Montelibano

Ombudsman Conchita Carpio Morales has directed Deputy Ombudsman for Visayas Pelagio Apostol to submit a report on the action his office has taken on the eight cases filed against Silay City Mayor Jose Montelibano and others.

Morales issued the directive following a letter from Jose Lindy Chan Jr. of Employee Subdivision, Barangay Mambulac, Silay City, in relation to cases he filed.

The cases are OMB-V-C-08-0340-H (for violation of Sec. 3 (e), R.A. 3019) and OMB-V-A-08-0296-H (for abuse of authority); and OMB-V-C-08-0341-H (for violations of R.A. 9184 and Sec. 3 (e), R.A. 3019) and OMB –V-08-0297-H (for dishonesty, grave misconduct, and conduct prejudicial to the best interests of the service) for which Chan said motions for reconsideration have yet to be resolved, Morales said.

OMB-V-C-11-0258-F (for malversation of public funds through falsification of public documents) and OMB-V-A-11-0285-F (for grave misconduct, dishonesty, and contract of prejudicial to the best interest of the service );and CPL-V-08-0986 (alleged purchase of gasoline without bidding); for which Chan said since they were filed in December 2008, almost three years have passed and nothing has been accomplished yet by the fact-finding investigation, she added.

OMB-V-C-11-0232-E (for violation of R.A. 6713, P.D. 1445, R.A. 7160, R.A. 9184, falsification, and malversation) and OMB-V-A-11-0264-E (for misconduct, dishonesty, and conduct prejudicial to the best interest of the service); OMB-V-C-11-0231-E (for violation of R.A. 3019 and R.A. 6713) and OMB-V-A-11-0263-E (for grave misconduct, gross negligence, and conduct prejudicial to the best interest of the service): and OMB-V-A-0265-E (for immorality) (against Ignacio Javellana Salmingo) on which, Chan said his motions for preventive suspension had not been acted upon by the handling investigators, she also noted.

In OMB-V-A-0095-C (Manny Sultan v. Edgar Parcia), Chan claims that one Julio Calo had filed a case against Montelibano on October 21, 2011 in connection with the alleged disobedience of the mayor to implement the Order of the Office of the Ombudsman in this case relative to the suspension of 17 employees of Silay City, she added.

Chan also said another case was filed by Calo on November 22, 2011 against the mayor and personnel of the Land Bank of the Philippines for using these suspended employee in negotiating a loan for Silay City, Morales said.
