Pa meted 17 years
for daughter’s death

The call center agent who is facing parricide charges for the death of his 6-year-old daughter was meted 14 years and 8 months to 17 years in prison by Regional Trial Court Branch 43 Judge Philadelfa Pagapong Agraviador after he pleaded guilty during his re-arraignment, City ProsecutorAmando Abanado said yesterday.

Abanado said that Bernard Nolan, 28,of B.S. Aquino Drive, Bacolod City would have been sentenced to reclusion perpetua, or 40 years of imprisonment, but because he pleaded guilty, his sentence was reduced.

Abanado said Nolan informed him through a letter that he intended to enter a plea bargaining agreement. Abanado forwarded Nolan’s letter to the Department of Justice and it was approved by Prosecutor General Claro Arellano.

Nolan admitted to the crime during his re-arraignment on April 9, Abanado said.

While Nolan had already been meted the penalty and is now waiting for commitment to the National Penitentiary in Muntinlupa City, the case against his live-in partner Rachel Esguera continues.

The hearing for Esguerra’s petition for bail is set on August 23 at Branch 43.

Nolan and Esguerra were apprehended by the police on October 27, 2010, several hours after their daughter died at the Pablo O. Torre Memorial Hospital, where they had brought her.

City Medico Legal Officer Eli Cong, who conducted an autopsy on the victim, said his findings showed that the immediate cause of the child’s death was a blow to the head, but he could not determine what object was used to cause the fatal hit.

The child also suffered from bruises and hematomas all over the body, some of which were old,Cong said, which indicate that beatings had apparently been happening for some time, although he could not say how long.

The child had bruises on the face, back, right side of the abdomen and buttocks, he said.

There were lacerated wounds on the back that appeared to have come from a pointed object such as a knife, some of which were infected and some that had dried up,and on the buttocks a burn markappeared to have come from the tip of an iron, he said.

The bruises on the body of the childwere not even,which could indicate that the deeper parts were caused by the buckle of a belt and the slighter ones from the softer part of the belt, he added.*APN
