Dad meted 8 years for
death of daughter
BY ADRIAN NEMES III

The call center agent in Bacolod City who was facing parricide charges for the death of his 6-year-old daughter in 2010 was meted eight years and one day intermediate prison terms by Regional Trial Court Branch 43 Judge Philadelfa Pagapong Agraviador, and not 17 years, contrary to what was reported earlier, a copy of the resolution showed yesterday.

Prosecutor Gwendolyn Jimenea-Tiu said the maximum penalty for Bernard Nolan, 28, of B.S. Aquino Drive, Bacolod, is supposedly 17 years for parricide, but it was reduced to homicide since he pleaded guilty during his arraignment in April this year.

Prosecutor Armando Abanado had earlier told reporters that Nolan was meted 14 to 17 years in prison term.

Jimenea-Tiu said the time spent by Nolan at the Bureau of Jail Management and Penology while the case was in progress will be subtracted from his prison term.

She said that if Nolan will have a good record while serving his prison term at the National Penitentiary in Muntinlupa City, he can apply for parole.

Although Nolan has already been convicted and is now waiting for commitment to the National Penitentiary in Muntinlupa City, the case against his live-in partner, Rachel Esguera, continues.

The hearing for Esguerra's petition for bail is set on August 23 at Branch 43.

Nolan and Esguerra were apprehended by the police on October 27, 2010, several hours after their daughter died at the Pablo O. Torre Memorial Hospital, where they had brought her.

City Medico Legal Officer Eli Cong, who conducted an autopsy on the victim, said his findings showed that the immediate cause of the child's death was a blow to the head.

The child also had   bruises   and hematomas all over the body, some of which were old, Cong said, which indicate that beatings had apparently been happening for some time, although he could not say how long.

The child had bruises on the face, back, right side of the abdomen and buttocks, he said.

There were lacerated wounds on the back that appeared to have come from a pointed object such as a knife, some of which were infected and some that had dried up, and on the buttocks a burn mark appeared to have come from the tip of an iron, he also said. *APN
