Policeman faces
raps for neglect

Charges for serious neglect of duty will be filed  against a policeman before the Police Regional Office-6 for his failure to attend court hearings  that  led to the dismissal of an illegal drug case.

Bacolod City Police Director Senior Supt. Ricardo de la Paz said that  the charges will be filed against Police Officer 2 Wilson Go  who is assigned at the Traffic Management Unit,  based on the recommendation of the BCPO Investigation branch.

Contacted by the DAILY STAR, Go said he failed to attend the court hearings because he did not receive any subpoenas.

Go acted as poseur buyer  in an illegal drug operation conducted by the Intelligence and Investigationled by Supt. Harold Tuzon on September 9, 2011 at Gonzaga-Araneta Street, Bacolod where Gicylle Ramo was apprehended and four heat-sealed transparent plastic bags with suspected shabu were seized.

Based on the report submitted by Senior Police Officer 2 Jonito Pastrana of the investigation branch to de la Paz yesterday,  a subpoena was sent to Go on June 21, 2011 asking him to attend the hearing on the case scheduled on September 13, 2011 which he acknowledged to have received.

Regional Trial Court Judge Eliseo Geolingo rescheduled the hearing to January 26, 2012 since Go failed to appear on  June 21, 2011 but  Go again failed to attend the hearing on January 26,causing the judge to dismiss the case against Ramo.

The National Police Commission Memorandum Circular 2007-00 states thatif the non-appearance of a policeman in court hearings resulted in the dismissal of the case or the acquittal of the accused, the penalty of dismissal from service shall be imposed because it is tantamount to serious neglect duty, De la Paz stressed.

Go said he failed to attend the January 26, 2011 hearing because the non-uniformed personnel of TMU gave the subpoena late. He added that he was not given chance by the Investigation branch to explain why he failed to attend the hearings.
