‘Janitors’ termination valid’

The Seventh Division of the National Labor Relations Commission of Cebu City declared as valid the termination by the Bacolod Our Lady of Mercy Specialty Hospital of its janitors and orderlies with redundancy as the firm’s reason, a press release from BOLMSH said.

In a decision promulgated on December 29, 2011, the NLRC reversed a decision dated August 25, 2011 of Labor Arbiter Henry Taňoso, the press release said.

The commission recognized as valid the BOLMSH management’s act of phasing out its janitorial and orderly departments, it added.

The NLRC said that because there was a justification for the termination of complainants’ employment with BOLMSH, there was no basis for the order of Taňoso for the 16 remaining complainants to be reinstated and for the payment of backwages and attorneys fees, the press release said.

The motion by the BOLMSH Employees’ Union for reconsideration of the ruling was denied by the NLRC in a Resolution promulgated on March 30.

The BOLMSH management and the employees’ union recently signed a five-year collective bargaining agreement and approved the P10 daily wage increase, for the workers for three years, Roberto Villaram, the personnel’s association president, had said. *
