The Election Registration Board of the Commission on Elections in Don Salvador Benedicto town has granted the opposition filed against the application of lawyer Jose Max Ortiz for transfer as voter of Precinct No. 0041A of Barangay Kumaliskis in DSB.
The ERB resolution was signed by its chairman Election Officer II Mary Ann Davila and members, Municipal Civil Registrar Jeremy Celeste and Education District Supervisor Cleopatra Alegrado.
The opposition to Ortiz’s application for transfer of registration was filed by Kumaliskis resident Fernando Toreno for lack of residency.
Ortiz, in answer, claimed that he has been a resident of Kumaliskis for almost seven years , however, his house was completely burned in March 2012, the ERB resolution said.
The ERB noted that Ortiz admitted that he has a house in Bacolod City that also serves as his office.
Ortiz claimed that he stays in Bacolod during weekdays and goes back to the Kumaliskis on the weekends, the ERB said.
Respondent’s conduct revels his lack of intention to stay permanently in Kumaliskis as evidenced by the fact that he used a tent as his sleeping quarters, and later rented a room, instead on reconstructing his house in Kumaliskis, the ERB added.
The fact that he returns to his house in Bacolod City shows that he has not abandoned his old domicile, when he applied for transfer of registration, the ERB noted.
