Motion filed on ERC ruling

A motion for reconsideration asking the Energy Regulatory Commission to reconsider its latest order and transfer the hearing venue of ERC case No. 2012-003-CF to Bacolod City was filed Wednesday by the Social Action Center represented by Elinore Cabanilla.

The hearing involves the Central Negros Electric Cooperative’s application for approval of under-recoveries totaling P414.6 million.

In the motion for reconsideration dated September 27, Cabanilla said the order and notice of hearing issued by the Commission was received by the SAC late Tuesday afternoon and they were taken by surprise that the continuation of the hearing held in Bacolod City on June 8, had been set today at the ERC’s main office in Pasig City, Manila.

She said they believe that the initial hearing conducted at the CENECO compound was not fully concluded, thus the continuation was expected to be at the same venue.

Cabanilla said it is obvious that attending the hearing in Manila will result in substantial expenses. Such financial constraints will affect the attendance at the hearings by affected consumers of CENECO and some oppositors/intervenors, including herself, she said.* CGS
