Sayson won’t inhibit self
from case vs. Alejandrino

Bacolod Vice Mayor Jude Thaddeus Sayson has denied the motion filed by Sangguniang Panlungsod Secretary Nilo Alejandrino asking him to inhibit himself in the case filed by Councilor Caesar Distrito, saying it has not raised substantial ground or argument to warrant it, and upheld the order he had issued against the former.

An omnibus motion was filed by Alejandrino asking that Sayson’s Order dated Nov. 2, 2011 be reconsidered and set aside and that Sayson inhibit himself from hearing the case and transfer the venue of the hearing to the Civil Service Commission.

The case involves a chair throwing incident involving the two officials.

Sayson had issued an order dated November 2, 2011 denying Alejandrino’s motion to inhibit, saying that he is deemed to have waived his right to present his evidence.

After an investigation is conducted and if a prima facie case is established, a formal charge will be issued by the disciplining authority, otherwise, the complaint will be dismissed, he said.

In his Order dated Nov. 21, Sayson said that upon the issuance of the formal charge, Alejandrino is given the authority to file his answer to refute the charges against him, (Rule II, Sections 16 and 17, Revised Uniform Rules on Administrative Cases in the Civil Service), thus, due process is still afforded him.

Moreover, Sayson asked that it be put on record that he belongs to the Nationalist People’s Coalition, while Distrito belongs to the Nationalista Party, and this belies the claim of Alejandrino that he and the complainant were partymates during the 2010 elections.

He also said that mere allegations of perceived partiality and bias without strong and concrete evidence to support them are not valid grounds for him to inhibit from hearing the case.*CGS
