SC denies petition
of Recto vs. Peña

The Supreme Court First Division has denied a petition for review on certiorari filed by Marie Roxanne  Recto to a ruling of the Court of Appeals  affirming a decision denying her application for a permanent protection order against former Pulupandan Mayor Magdaleno Peña, documents sent by his staff showed yesterday.

Considering the allegations, issue and arguments adduced in the petition for review on certiorari, the SC said it resolved to deny the petition for failure of the petitioner to sufficiently show that the Court of Appeals committed any reversible errors in the challenged decision and resolution.

On July 12, 2005 Recto filed a petition for issuance of a temporary/permanent  protection order against Peña  based on the allegation that he mauled  her. The Mandaluyong Branch 214 denied Recto’s petition  for a PPO which was upheld by the CA .*
