Guv’s case vs.
Peña dismissed
BY CARLA GOMEZ
San Carlos City Regional Trial Court Branch 59 Judge Kathrine Go has dismissed the criminal case for libel filed by Negros Occidental Gov. Alfredo Marañon Jr. against former Pulupandan Mayor Magdaleno Peña, without prejudice to its refiling in the proper court.
In her order dated September 27, a copy of which was furnished the DAILY STAR by Peña’s lawyer, Roem Arbolado, yesterday, Go said the court resolved to quash the information filed and ordered the dismissal of the case for lack of jurisdiction.
Go also said the offended party, a public officer, has the option of filing a criminal or civil action for libel in the place where the libelous item was printed and first published, or in the place where the public officer held office at the time of the commission of the offense. |
