A resident of Talisay City, Negros Occidental, was sentenced to 14 years and 8 months imprisonment for the crime of homicide.
Bacolod Regional Trial Court Judge Manuel Cardinal Jr. sentenced Eduardo Porlas Panes to suffer the penalty of six years and one day as minimum, to 14 years, 8 months and one day as maximum imprisonment at the National Penitentiary in Muntinlupa, Rizal.
Panes was arrested for stabbing to death Vic Paez Oyog at Octagon Village in Zone 15, Talisay City, Negros Occidental, on July 17, 2008.
Cardinal said he will be allowed full credit for his detention. He also ordered Panes to pay the family of his victim P45,000 in actual damages, P75,000 in moral damages, and P15,000 in exemplary damages.
Panes and Oyog had joined a drinking spree at the house of a friend, who was celebrating his birthday. When they went out to urinate, Panes allegedly boxed Oyog, chased him with a knife and stabbed him, the court was told.
Panes had confronted Oyog about the loss of his fighting cocks a few days earlier after he caught him within the premises of his farm, court records show.
The court was not convinced with the story presented by the defense that Panes only acted in self-defense against the imminent danger to his life.
The court said that when Panes stabbed the victim, he took him by surprise, which ensured his helplessness, defenselessness and immobility.*CPG
