SC denies with finality
Recto protection bid

The Supreme Court First Division has denied with finality a petition for review on certiorari, filed by Marie RoxanneRecto to a ruling of the Court of Appealsaffirming a decision denying her application for a permanent protection order against former Pulupandan Mayor Magdaleno Peña, documents sent by his staff showed yesterday.

The SC in its decision, dated Nov. 20, 2013, said the petitioner’s motion for reconsideration to its July 29, 2013 had no substantial argument to warrant a modification of the court’s resolution, and thus is denied with finality.

Considering the allegations, issue and arguments adduced in the petition for review on certiorari, the SC had earlier said it resolved to deny the petition for failure of the petitioner to sufficiently show that the CA committed any reversible errors in the challenged decision and resolution.

On July 12, 2005, Recto filed a petition for issuance of a temporary/permanentprotection order against Peña,based on the allegation that he mauledher.

The Mandaluyong Branch 214 denied Recto’s petitionfor a PPO, which was upheld by the CA.*
