The Civil Service Commission dismissed the administrative complaint filed by Bacolod City Water District director Marichi Ramos against general manager Juliana Carbon and 66 other employees in relation to the noise barrage held at the Baciwa compound August last year, for lack of prima facie case.
Ramos filed the complaint against Carbon and the Baciwa employees on several grounds such as disrespect to authority, abandonment of work during office hours and defiance to policy among others.
The complaint stemmed from the August incident where Ramos, together with directors Lawrence Villanueva and Lorendo Dilag, forced their way into the Baciwa compound to conduct an investigation on the administrative charges filed by Ramos against Carbon.
They remained inside the boardroom while employees of the water district held a noise barrage outside and were only able to leave the compound after they were escorted by the police.
In his order CSC director IV Rodolfo Encajonado, said the complaint of Ramos against Carbon for insubordination, conduct unbecoming of government official, and conduct prejudicial to the best interest of the water district is dismissed for lack of prima facie case.
Asked for her comment, Ramos said they expected this since Encajonado is allegedly a close friend of Carbon. They only learned about this last month, she said.
Truth will always prevail, sooner or later, Ramos said. “I hang on to my faith. Good will always triumph over evil,” she said.
Ramos said she is praying that there will be someone who could read their evidences properly and give them a chance to file their answer and not just rule on the matter and dismiss it for “lack of evidence.”
“I have all the pictures and videos. What other evidences is Encajonado asking for when it was obvious and self explanatory that Carbon was seen on the front page of a daily newspaper banging the post and allegedly leading other employees to do the same and abandon their work so the investigation of the 10 charges against her will not push through?” she said.
Encanojado said there was no evidence that Carbon, et al had the intention to stop working or to disrupt services when they conducted the noise barrage.
He also said there was no evidence to substantiate that Ramos’ allegations that Carbon ordered the security guards to the gate or that the latter conspired with union president Claudio Salmo and other union members employees to hold a noise barrage.
The picture of Carbon holding a steel rod and the video footage of her interview do not support the allegation of misconduct or unlawful behavior. More importantly, there is no showing that Carbon’s participation in the noise barrage resulted to undue prejudice where Baciwa was denied of her service, Encanojado also said.
Samuel Penado, assistant general manager for operations, said the noise barrage was a show of the real sentiments of the Baciwa employees.
Carbon said the noise barrage was a spontaneous act of the employees and they cannot be blamed for doing it .*CGS
