Legal issues

Benjamin Calderon

Last week was full of surprises that continues to come along the way but in another field of interest. With my elder sister scheduled to visit home, the need to prepare legal documents that need to be signed become a priority in the things-to-do list. I remember a teacher pointing out that the legal aspect of life is born out of a person's horizontal relationship with fellow man and those with man-made institutions. The law exists to establish order in human society. The settlement of estates of parents does provide legal requirements to be complied with, and preparation of the required legal documents takes some time.

It is like taking on the challenge of receiving goat breeders from the government that needs proper documentation of the agreement, acknowledgment and commitment. Just like a father seeing a long dreamt for child was the happiness the farmer enjoyed when the animals were delivered. Inspection of the travel stressed goats revealed one had a cough while another had a foot wound and immediate treatment was given. Even the spending, rather, investing on copra meal, tahop and molasses was done in a very light manner. The money easily came out of the wallet.

Our feet are brought back to the ground when we received a legal summons on a work-related issue. The husband of client sued the creditor for not securing the consent of the spouse over a conjugal property that was subsequently mortgaged. Another surprise of a legal kind that does not make you smile. However, we learn to accept what comes our way. The important choice is how we accept and respond to the challenge. A co-worker encouraged us to remain positive as this opens our minds and hearts to the lessons to be learned. So we stopped talking and feeling sorry for ourselves and agreed that the legal defense be entrusted to a lawyer. In a similar manner, we just enrolled in law school and are tasked to learn to be better persons by being more informed in law and hopefully more prudent.

Let us end with an attempt at humor in recognition of the service given by our lawyers to their fellow men with the following anecdote entitled “unfit words to hear”.

A woman was being questioned in a court trial involving slander. "Please repeat the slanderous statements you heard, exactly as you heard them," instructed the lawyer.
The witness hesitated. "But they are unfit for any respectable person to hear," she protested.

"Then," said the attorney, "just whisper them to the judge."*
