SP passes ordinance
on liquid petroleum

An ordinance prescribing the calibration and sealing of dispensing pumps of liquid petroleum products retail outlets in Bacolod City, imposing fees for the registration and sealing of dispensing pumps, was passed by the Bacolod Sangguniang Panlungsod on third and final reading Wednesday.

The ordinance provides that all dispensing pumps used in the retailing of liquid petroleum products within Bacolod City must be properly calibrated every 60 days, and sealed by the treasurer or his/her authorized representative.

A dispensing pump that is not calibrated or sealed, or goes off calibration will be marked with an “out-of-order” sign and will not be used until the pump is calibrated and sealed, it said.

The ordinance provides that any retail outlet owner/operator found violating the ordinance will be meted a penalty of P4,000 and/or imprisonment of one month for the first offense, and a fine of P5,000 and/or imprisonment of two months for the second offense.

Revocation of permit to operate business and/or imprisonment of three months at the discretion of the Court will be imposed for the third and subsequent offenses. In case of a corporation, the penalty of imprisonment will be suffered by the chairman of the Board or the president, it added.

The SP also passed on third and final reading Wednesday an ordinance requiring all banks and other financial institutions, as well as certain business establishments within Bacolod City, to install closed-circuit television within their premises.

The installation of the CCTV device will be required within three months from the passage of the ordinance for those with existing Business Permits and before issuance of the required Business Permits for new businesses.

The ordinance provides that violators of Section 3 of the ordinance will be given a warning and a fine of P3,000 for the first offense, revocation of business permits and a fine of P5,000 for the second offense.

It said violators of Sections 4 and 5 of the ordinance will be meted a fine of P5,000 and penalty of not less than one month or both at the discretion of the Court. If the offender is a corporation, the manager or president will be held liable.

Meanwhile, the SP also passed on third and final reading an ordinance requiring all amusement and/or gaming establishments to obtain a resolution of no objection from the SP before its operations within the territorial jurisdiction of Bacolod City, providing penalties for its violation and other purposes.

The ordinance states that several amusement and/ or gaming establishments have been in operation in Bacolod City without the required consent of the local government units by Section 10 of RA 9487, or the Revised PAGCOR Charter.

Any person natural or juridical, found in violation of the ordinance will suffer the penalty of imprisonment of six months or fine of five of P5,000 or both, at the discretion of the court. This aside from the immediate revocation and/or cancelation of the business permit, permit to operate, franchise or other similar privileges earlier granted.

If the offender is a juridical entity, the manager or president or chairman of the Board of Directors or managing partner or its equivalent, will suffer the penalties provided, the ordinance said.
