The Office of the Ombudsman for the Visayas had given due course to the criminal complaint filed by Councilor Caesar Distrito against Bacolod Sangguniang Secretary Nilo Alejandrino, and ordered the latter to submit a counter-affidavit.
Assistant Ombudsman Virginia Palanca-Santiago, in her order dated January 10, directed Alejandrino to file his counter-affidavit and other controverting evidence to the complaint filed by Distrito.
Distrito filed a criminal complaint against Alejandrino with the Ombudsman for grave oral defamation, violation of the Magna Carta for Persons with Disability and two counts of threat.
Earlier, the Ombudsman had issued an order assigning the case to an investigating officer after it found sufficiency in substance to the complaint filed by Distrito against Alejandrino.
The string of criminal cases are separate from the administrative complaint for grave misconduct, abuse of authority, gross insubordination, conduct unbecoming and unprofessional conduct, which was lodged by Distrito with the disciplining authority or the Office of the Vice Mayor, who subsequently meted Alejandrino a 60-day suspension based on the complaint.
Meanwhile, Deputy Ombudsman Pelagio Apostol wrote Alejandrino that the criminal and administrative cases he had filed against Distrito had been assigned to an investigation officer who will act on them, appropriately.
Alejandrino had filed administrative and criminal complaints against Distrito for violation of R.A. 6713 or an Act Establishing a Code of Conduct and Ethical Standards for Public Officials and Employees, violation of the Anti-Graft and Corrupt Practices Act, violation of the Revised Pena Code more particularly Article 210 on bribery, dishonesty and conduct unbecoming of a public official.*CGS back
