Bacolod Councilor Caesar Distrito yesterday said he had expected the dismissal of the complaint he filed against the late Sangguniang Secretary Nilo Alejandrino before the City Prosecutor's Office.

Under the law, he said, once the respondent dies, he or she is considered absolved from any criminal liability.

The Office of the City Prosecutor of Bacolod City dismissed the complaint of subornation of perjury filed by Distrito against the Alejandrino and a complaint of perjury against the latter's witness Orlando Torre, for lack of probable cause.

Distrito filed the criminal and administrative and cases against Alejandrino last year at the Office of the Vice Mayor and the Ombudsman for the Visayas, for an incident at the Sanggunian Secretary's Office.

Distrito said “Although I maintain my stand that they committed the acts complained of, perjury and subornation of perjury, as they used a perjured statement of Torre who was not present when the incident happened, however, considering that Alejandrino has already died, I will no longer pursue my appeal or file a motion for reconsideration to the decision of the City Prosecutor, as a sign of respect.”*CGS.
