The Bacolod Bids and Awards Committee disqualified the Metrowaste Solidwaste Management Corp. Thursday since the area where it was supposed to put its transfer station is located in a residential area.
BAC vice chairman Maphilindo Polvora yesterday said that with the disqualification of the two bidders for the privatization of garbage collection in Bacolod City, the Mayor may declare a failure of bidding based on the recommendation they will be submitting to him.
The BAC had, earlier disqualified Dynamic Builders during the post qualification stage it conducted after finding out that its business permit does not include the hauling business.
Polvora said their decision regarding Metrowaste focused on the opinion of the Government Procurement Policy Board, although it did not issue a categorical statement whether to disallow or award the project to the bidder.
Based on the opinion of the GPPB Legal Department, even if a bidder passed the technical, financial or legal requirement, if there are other factors like issues pertaining to environmental laws and other special laws, this is still ground for disqualification, he said.
So they based their decision on the answer of the GPPB to the letter of former BAC chairman Goldwyn Nifras seeking its legal opinion, Polvora said.
They received the letter dated November 9 signed by Dennis Santiago, Executive Director 3 of GPPB, on November 13, he said.
Polvora said the main reason why they disqualified Metrowaste is because the property where it is supposed to put up a transfer station is located in a residential zone.
Based on City Ordinance 216, the area is classified as a residential zone and transfer stations are not allowed in these areas, he said.
Dynamic Builders offered a bid of P69,107,140.80 while Metrowaste Solidwaste Management Corp. offered P69,910,711.80 out of the P72 million Approved Budget for the Contract for the privatization of garbage collection in Bacolod City.*CGS back
