extension on HLURB order

 Active Construction Inc. has filed a motion for clarification and extension before the Housing and Land Use Regulatory Board in Western Visayas, to extend the period for it to comply with the HLURB order involving the Town and County-Negros subdivision in Talisay City, Ma. Valerie Villar, executive vice president and general manager of ACI-Talisay, said yesterday.

Housing and Land Arbiter Mechor Calopiz, in a decision dated May 22, ordered ACI, a subsidiary of Active Group Inc., to repair the amenities and do maintenance work in the subdivision.

Members of the TCN Homeowners/Lotowners Association Inc. had filed a complaint against ACI, developer of the subdivision, before the HLURB last year for breach of contract, specific performance of contractual statutory obligations, fraudulent practices, manipulation, and unsound business practices and damages.

In a letter sent to the DAILY STAR yesterday, Villar said the HLURB “dismissed the association’s complaint, finding no evidence for these charges”, but ordered the ACI to do repair and maintenance work.

She said they are given a 30-day period to comply with the order and it has not expired yet since they received a copy of the decision on June 6, 2012.

“We moved for clarification and extension, thereby (the motion) effectively extended the period of our compliance,” Villar said.

Villar also said the Motion for Clarification they filed must first be resolved before they can act on the order.

The TCN homeowners/lotowners association has also filed an appeal to the decision and section 4, of Rule XVI of the HLURB Rules, states that “the filing of an appeal in accordance with these rules shall have the effect of automatically staying the execution of any decision or order of the Arbiter,” she added.*LTG
