A homeowner of Fiesta Homes Subdivision, in Brgy. Sum-ag, Bacolod City, is opposing the proposed construction and operation of a gasoline station near his property.
In a petition filed before the Housing and Land Use Regulatory Board in Iloilo City dated April 2, 2012, Alfredo Daquila claimed that the putting up of a gas station by Phoenix Petroleum Philippines in the subdivision, is in violation of the provisions in the Contract to Sell and the Absolute Deed of Sale between the subdivision developer and the homeowners.
He added that the contract spells out 22 restrictions on the kinds of business that may be allowed the lot owners, among them, those that are noxious due to odor, fumes, dusts, or dangerous to life and property due to fire hazards or explosions.
Daquila, who furnished Mayor Evelio Leonardia a copy of his petition, is asking the HLURB, which he said has jurisdiction over contracts to sell, deeds of absolute sale, and on land use regulations, to order developer Elnor Investment Co. Inc. to strictly implement the restrictions.
He said that while he was assured by Elnor general manager Martin Poblador, in a letter dated July 6, 2011, that the restrictions will be strictly observed, actions on the establishment of the gas station, have caused “anxiety, emotional and psychological disturbance” to him and other homeowners.*CGS back
